Transsexuality banned for people with perfect sex

03/09/2008
The Government on August 5 issued a decree banning transsexuality for people with perfect sex. This is applied to all organizations and individuals at home and abroad.

The decree also stipulates that transsexuality must be conducted voluntarily, in good faith and based on scientific evidence.

Transsexuality is only legal when it is approved by the Health Ministry or the Health Departments in centrally-governed cities or provinces.

Those who have been legally transsexualised will be provided with a health certificate which enables them to change birth and marriage certificates and other personal documents.

The people who have undergone sex change in other countries or in Vietnam prior to August 5 must get a certificate from the health care centre where they received surgery if they wish to alter their legal documents. However, they must also go to Vietnamese health care centres for further examination to acquire the new certificate.

The decree also requires that all information relevant to people undergoing transsexuality must be kept confidential. Discrimination is forbidden.

The decree will come into effect 15 days after its publication in the official gazette.
